Privacy Policy

This policy explains what personal data Sea Wave Yachts collects, why, and what rights you have over it.

1. Who we are

Sea Wave Yachts is operated by Sea Wave Adventures OÜ, Tornimäe tn 7–169, Tallinn 10145, Estonia ("we", "us"). We are the controller of your personal data and process it under the EU General Data Protection Regulation (GDPR). For anything privacy-related, email privacy@seawaveyachts.com.

2. When you contact us

When you send an inquiry through the website, or contact us by email, phone or WhatsApp, we receive your name, email address, phone number if you give it, your message, and which boat you asked about. We need your name and a way to reach you in order to reply.

We use this only to answer you and to help you buy, sell or look after a boat. The lawful basis is taking steps at your request before entering into an agreement with you, and our legitimate interest in replying to people who contact us. We keep inquiries for up to three years after our last contact with you, unless you ask us to delete them sooner.

Messages sent through WhatsApp are also handled by WhatsApp under its own privacy policy.

3. When you sell your boat through us

If you instruct us to sell your boat, we collect your name and contact details, the boat's details, and a written record of our intake call with you. We may send you a private link so you can check and complete that record yourself; the page is excluded from search engines, and the link expires.

All of it is used for one purpose: to prepare and market the listing you have asked us to prepare. The lawful basis is performance of our agreement with you rather than consent, which is why there is nothing to tick.

To turn the record of our call into your boat's details, we use an AI service, Anthropic, as our processor. It processes the record only on our instructions and does not use it to train its models.

The written record of the call is deleted once your boat is listed, and otherwise after twelve months with no activity on your file. The boat's details and your contact details are kept for as long as we act for you, and afterwards only as long as the law requires us to keep records of the sale.

Photographs you send us are used internally to prepare the listing and are not published — the photographs on our listings are our own.

4. When you browse the website

Our server records technical data with each visit: your IP address, browser type, the pages you request and when. We use it to keep the site running and secure, including briefly using your IP address to limit how often a form can be submitted, which stops spam. The lawful basis is our legitimate interest in a secure website. These logs are deleted automatically within 30 days.

With your consent only, we use Google Analytics to count visits and see which pages are useful. You give or refuse consent in the cookie banner, and you can withdraw it at any time; see our Cookie Policy. Google keeps this data for up to 14 months.

Listing videos and 3D tours load only when you click them. At that point your browser connects to the provider (such as YouTube), which receives your IP address.

5. Who receives your data

Your data stays with Sea Wave Yachts: we do not sell it and do not share it with other companies for their own purposes. We use these service providers, who process it only on our behalf:

• Hetzner Online — hosts the website and its database in Finland.
• Google — our email, and website analytics if you consent.
• Anthropic — prepares the boat details from the record of an owner's intake call (sellers only).

We may also disclose data where the law requires it, for example to a tax authority or a court.

6. Transfers outside the EU

Google and Anthropic may process data in the United States. These transfers are protected by the European Commission's Standard Contractual Clauses or the EU–US Data Privacy Framework.

7. Your rights

You have the right to access your data, to have it corrected or deleted, to restrict or object to how we use it, and to receive it in a portable format. Where we rely on your consent, you can withdraw it at any time. We do not make decisions about you by automated means alone.

To use any of these rights, email privacy@seawaveyachts.com. We reply within one month.

You can also complain to a data protection authority: in Estonia, the Data Protection Inspectorate (www.aki.ee), or the authority in the EU country where you live.

8. Changes to this policy

If we change this policy, we will publish the new version here and update the date at the top.
