Buying a yacht from the UK after Brexit

Since 1 January 2021 the UK is outside the EU. A UK boat needs proof of EU VAT status, or it must be imported with VAT and any duty.

Key points

  • UK-located boats are no longer inside the EU customs territory.
  • Sources disagree on how pre-Brexit VAT-paid boats keep their status. Ask for documents and a written view from customs.
  • A UK-flagged boat stays UK-flagged until you re-register it.

What changed on 1 January 2021

The UK left the EU customs territory and the EU VAT area. A boat in the UK, whatever its flag, is no longer in the EU. A boat moving from the UK to Spain is moving from outside to inside the EU, and customs and VAT questions follow.

Two cases

  • The boat was VAT paid in the EU before Brexit. It may keep its EU VAT paid status, if you can prove it and it has not lost it. Sources describe a three-year limit on time outside the EU. Accounts differ on how the UK authority has applied the rule, and the position has changed since 2021. Ask for the original EU invoice and the movement history, and ask the Spanish customs office before you commit.
  • The boat was bought or imported to the UK after Brexit. Assume it counts as VAT not paid for EU purposes. The Spanish import brings VAT at 21% and possible customs duty, and a UK seller may be able to sell without UK VAT on export.

Duty

Whether customs duty applies depends on the tariff classification and origin of the boat. The EU-UK trade agreement gives duty-free treatment to goods with UK origin under conditions, and the boat may have been built in a third country. Get the answer from a customs agent for the specific boat.

Paperwork to request

Conformity

A boat built in the UK after the EU rules took effect needs to meet them to be used in the EU. Check the CE or conformity paper. See CE marking and the Recreational Craft Directive: design categories A to D.

After the purchase

The flag stays British until you register the boat elsewhere. If you live in Spain, using a boat under the UK flag does not solve your Spanish tax questions.
