Choosing a flag and registering your yacht
A boat has one flag. The flag sets who can own it, what safety gear and licences apply, and which register holds the mortgage. It does not set VAT status.

Key points
- A boat can fly one flag at a time. Changing it means deregistering from the old register first.
- Flag and VAT status are separate questions.
- If you live in Spain, a foreign flag does not remove Spanish tax questions.
What the flag decides
- Who can register. Each country sets rules on nationality, residence or company ownership.
- The rules aboard. Safety equipment, inspections and skipper licences follow the flag. See Skipper licences in Spain: PNB, PER, Patrón and Capitán de Yate, and foreign licence recognition and Essential safety equipment by flag and category.
- Which register records ownership. Lenders register mortgages there. See Financing a yacht in Europe: marine mortgages and leasing.
- How authorities in other countries treat the boat. Some flags draw more checks in some ports.
What it does not decide
The flag does not decide VAT or customs status, and neither does the owner's nationality. See What does VAT paid mean on a yacht?. A boat on the Spanish register can be VAT not paid, and a boat on a foreign register can be VAT paid.
Your options
- Spain. Lista 7 for private use, Lista 6 for commercial charter. See How to register a yacht in Spain: Lista 6 vs Lista 7 (commercial vs private).
- Your home country. Poland, France and the UK are the common alternatives. See Polish yacht registration, French yacht registration and UK Part I vs SSR.
- Another flag. Open to those who qualify, usually through a company. Ask a lawyer.
Questions that decide it
- Where do you live for tax, and for how many days a year?
- Where will the boat spend most of its time?
- Will you charter it?
- Do you need a mortgage?
- Which licence do you hold?
The honest short answer for most Spanish residents is to register in Spain, because Spanish rules already apply to your use of the boat. See Can a Spanish or EU resident use a foreign-flagged yacht?.
